The "Gentrepreneur Partnership" is a collaboration between Artevelde University College, Ghent University, HOGENT, KU Leuven – Ghent, Odisee University College, and Luca School of Arts, with the support of the City of Ghent, the Province of East Flanders, and VLAIO. Gentrepreneur Company CV is active within this collaboration as a cooperative company.
These General Terms and Conditions apply between Gentrepreneur and the Participants (as defined below).
- Definitions
In these General Terms and Conditions, the following definitions apply:
- Activity/Activities: An activity or event organized by Gentrepreneur.
- General Terms and Conditions: These general terms and conditions.
- Coaching(s): An individual advisory meeting or a group advisory meeting organized by Gentrepreneur.
- Participant(s) / you / your: Visitors or users of a Website, participants in our Activities, and users of our Services.
- Services: All services offered by Gentrepreneur, including but not limited to Coachings, registrations for Activities, provision of information, and networking activities.
- Gentrepreneur / we / us: The legal entity acting under the Gentrepreneur name or offering, organizing, or managing the relevant Services / Activities / Website. This may concern one or more of the following legal entities:
- Gentrepreneur Company (CV), 0633.692.189, Hoogpoort 15, 9000 Ghent
- Ghent University (public institution with legal personality), 0248.015.142, Sint-Pietersnieuwstraat 25, 9000 Ghent
- Arteveldehogeschool (VZW), 0474.120.360, Hoogpoort 15, 9000 Ghent
- Hogeschool Gent (public institution with legal personality), 0255.647.755, Gerard de Duivelstraat 5, 9000 Ghent
- Website(s): A Website managed by Gentrepreneur or through which Gentrepreneur offers Services, including www.gentrepeneur.gent, www.gentrepreneur.be and https://gentrepreneur.startium.be.
- Applicability
- These General Terms and Conditions apply to all offers, agreements, Activities and Services of Gentrepreneur, as well as to the use of our Websites.
- By making use of the Services of Gentrepreneur, participating in an Activity or using a Website, you accept these General Terms and Conditions and their application.
- Deviations from these General Terms and Conditions are only valid if they have been expressly agreed in writing.
- If one or more provisions of these General Terms and Conditions are null and void or annulled, the remaining provisions shall remain fully applicable.
- Website and online services
- Gentrepreneur strives to make the Website and online Services available as much as possible, but cannot guarantee that they will function at all times without interruptions or malfunctions.
- Gentrepreneur strives to keep all information on the Website and in other communications as accurate and up to date as possible, but cannot guarantee that this information is always complete, correct, or current.
- Gentrepreneur reserves the right to temporarily take the Website or online Services out of use for maintenance, adjustments, or improvements.
- The Participant is responsible for using the appropriate equipment and software to gain access to the Website and online Services.
- It is not permitted to:
- Circumvent or hack the security of the Website or online Services;
- Provide incorrect information via the Website (e.g. when creating a profile);
- Use the Website or online Services in a way that may hinder or damage their functioning; and
- Use automated programs, such as bots or scrapers, to gain access to the Website or online Services.
- The use of certain Websites (e.g. gentrepreneur.startium.be) may be subject to additional terms of use. Those specific terms of use apply in addition to these General Terms and Conditions.
- Gentrepreneur is not responsible for the accuracy, completeness, or reliability of information shared by other Participants or third parties on its Websites. All information provided by third parties falls under the responsibility of the relevant third party and not under that of Gentrepreneur. In addition, Gentrepreneur is not liable for events or activities organized by third parties, such as sponsors, and shared via a Website.
- Services and activities
- The content, dates, times, and locations of Activities are announced via the Website, newsletters, or other communication channels of Gentrepreneur.
- Gentrepreneur reserves the right to make changes to the program, content, dates, times, or locations of Activities. Such changes do not give the Participant any right to compensation.
- Gentrepreneur strives to provide accurate and up-to-date advice during Coachings, but cannot guarantee that shared advice or information is always complete, correct, or current. The advice provided during a Coaching constitutes a personal opinion of a Gentrepreneur coach or staff member. The Participant cannot hold Gentrepreneur or the Gentrepreneur coach or staff member liable for incomplete, outdated, or inaccurate advice.
- Gentrepreneur reserves the right to refuse to provide Services (including Coachings) to certain persons for ethical reasons, including but not limited to cases where the person’s conduct or business plans conflict with the values and standards of Gentrepreneur. In such cases, Gentrepreneur will, where possible, inform the person concerned of the reason for the refusal.
- Registrations and cancellations
- Although Gentrepreneur primarily focuses its Activities on young entrepreneurial persons in Ghent between 18 and 25 years old, or persons at a higher education institution campus in Ghent, participation in Activities is in principle open to everyone, unless stated otherwise. Gentrepreneur may apply specific admission criteria for certain Activities or Services. These criteria will be communicated in advance.
- Participation in certain Activities requires prior registration. Registration takes place via the Website, a registration website, by email, or in another manner indicated by Gentrepreneur.
- A registration is only final after confirmation by Gentrepreneur. Gentrepreneur reserves the right to refuse registrations without giving reasons.
- When registering for events or Activities, Gentrepreneur expects the presence of the Participant. If the Participant is unable to attend, the Participant must inform Gentrepreneur as soon as possible.
- Cancellation by the Participant must take place by email or in the manner indicated on the Website (e.g. cancellation link). In the event of late cancellation or no cancellation by the Participant, Gentrepreneur reserves the right to charge a reasonable cancellation fee. In case of repeated non-attendance, Gentrepreneur may refuse or cancel the registration of a Participant.
- Gentrepreneur reserves the right to cancel Activities if there are insufficient registrations or in case of force majeure. In such cases, any participation fees will be refunded.
- Gentrepreneur expressly reserves the right to refuse or remove persons from Activities without giving reasons, for example in cases of:
- Inappropriate or disruptive behavior
- Failure to follow instructions of staff members or representatives of Gentrepreneur
- Reaching the maximum capacity of a location
- Other circumstances that, in the opinion of Gentrepreneur, hinder the proper course of an Activity
- Liability
- Participation in Activities of Gentrepreneur takes place entirely at the Participant’s own risk.
- Gentrepreneur is not liable for any damage, direct or indirect, suffered by the Participant as a result of the use of the Services of Gentrepreneur or participation in Activities, unless the damage results from intent or deliberate recklessness on the part of Gentrepreneur.
- Gentrepreneur is in particular not liable for:
- Damage to, loss, or theft of personal belongings during Activities
- Personal injury or accidents during Activities
- Damage resulting from advice or information provided by Gentrepreneur
- Damage resulting from the cancellation or modification of Activities
- Damage caused by other Participants
- Indirect damage, consequential damage, loss of profit, missed savings, or damage due to business interruption
- The Participant agrees that the Participant cannot bring any direct claim (contractual or non-contractual) against an auxiliary person of Gentrepreneur, including but not limited to Gentrepreneur coaches, staff members, and experts. To the extent necessary, the Participant expressly waives such claims.
- If Gentrepreneur should be liable for any damage, liability is limited to the maximum amount paid out by Gentrepreneur’s insurer in the relevant case, or, if no payment is made, to a maximum of EUR 10,000.
- Intellectual property
- All intellectual property rights relating to the content of the Website, events, presentations, documents, and other materials of Gentrepreneur remain with Gentrepreneur or its licensors.
- It is not permitted, without prior written consent of Gentrepreneur, to:
- Reproduce, distribute, publish, or modify materials of Gentrepreneur
- Record, copy, or distribute the content of presentations, workshops, or trainings
- Use trademarks, logos, or other distinguishing signs of Gentrepreneur
- It is permitted to share materials of Gentrepreneur via social media, provided that the source is mentioned and without commercial intent.
- Privacy and visual material
- Gentrepreneur processes personal data in accordance with applicable privacy legislation and the privacy statement, which is available on its Websites.
- During Activities, photos, video and audio recordings may be made for promotional purposes, reporting, and archiving. By participating in Activities of Gentrepreneur, the Participant gives consent for the creation and publication of this material in which the Participant may be recognizably depicted. If the Participant does not wish to be photographed or filmed, the Participant must notify Gentrepreneur in writing prior to the Activity. In such cases, Gentrepreneur will make efforts to avoid showing the Participant recognizably as a portrait, but cannot guarantee this in general atmosphere images or recordings of large groups.
- Gentrepreneur reserves the right to use image material for its own promotional purposes via the Website, social media, newsletters, and other communication channels, without the Participant receiving any compensation for this.
- Newsletter and communication
- By registering for the newsletter, the Participant gives consent to receive periodic updates about Activities, Services, and other relevant information from Gentrepreneur.
- The Participant may unsubscribe from the newsletter at any time via the designated link in each newsletter or by sending a request to Gentrepreneur.
- Gentrepreneur may contact the Participant with targeted communication about Activities or Services that match the Participant’s profile or interests (for example, as indicated in the Startium profile).
- Visibility on the website
- Gentrepreneur sometimes offers Participants the opportunity to gain visibility on its Websites, social media, poster and other marketing campaigns. To be eligible for this, Gentrepreneur may set specific conditions and may unilaterally change these at a later stage. Gentrepreneur has the right to unilaterally terminate a campaign or to no longer provide visibility to a Participant without further justification.
- Gentrepreneur reserves the right to refuse, remove, or adjust profiles without giving reasons.
- The Participant is responsible for the accuracy and timeliness of the information and image material provided.
- Gentrepreneur is not liable for any damage resulting from the publication of incorrect or incomplete information about the Participant or their enterprise.
- Rules of conduct
- The Participant shall conduct themselves during Activities of Gentrepreneur in accordance with public order, morality, and the rules of normal social conduct.
- The Participant shall follow instructions and directions of staff members or representatives of Gentrepreneur.
- The Participant is not permitted during Activities to:
- Behave in a discriminatory, intimidating, or otherwise inappropriate manner towards other participants or staff members of Gentrepreneur
- Distribute material that is contrary to the law, morality, or public order
- Engage in activities that may disrupt the proper course of the Activity (e.g. disruptive / unauthorized marketing practices)
- Engage in commercial activities (e.g. setting up a sales stand, placing banners) without prior consent of Gentrepreneur
- In case of violation of these rules of conduct, Gentrepreneur may deny the Participant access to the Activity or remove the Participant, without the Participant being entitled to reimbursement or compensation.
- Amendments to the general terms and conditions
- Gentrepreneur reserves the right to amend or supplement these General Terms and Conditions.
- Amendments will be published on the Website and take effect immediately. In the event of substantial amendments, Gentrepreneur will inform the Participants via its Website.
- If, after an amendment of the General Terms and Conditions, the Participant continues to make use of the Services of Gentrepreneur, registers for an Activity, or is present at an Activity, the Participant shall be deemed to have accepted these amendments.
- Applicable law and disputes
- These General Terms and Conditions and their application, as well as all agreements and legal acts between Gentrepreneur and the Participant, are governed by Belgian law.
- In case of disputes, the parties shall first attempt to reach an amicable settlement. If this proves not possible, disputes will be submitted to the competent court of the judicial district of East Flanders, Ghent division.
- Force majeure
- Gentrepreneur is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure or due to circumstances that severely impede the performance of a Service or Activity. Force majeure includes, among other things: extreme weather conditions, illness of staff members or speakers, government measures, power outages or failures of internet or telecommunication connections, pandemics or epidemics, and other unforeseen circumstances that make the performance of the Activity or Service impossible or irresponsible.
- In the event of force majeure, Gentrepreneur has the right to cancel, reschedule, or offer Activities in an adapted form, without the Participant being entitled to compensation.
- Final provisions
- If one or more provisions of these General Terms and Conditions are at any time wholly or partly null and void or annulled, the remaining provisions of these General Terms and Conditions shall remain fully applicable.
- In cases not provided for in these General Terms and Conditions, Gentrepreneur shall make arrangements in reasonableness.
- The most recent version of these General Terms and Conditions is always available on the relevant Gentrepreneur Website.
